Rules on staff representation

General information

The staff representation is the statutory body representing the interests of civil servants and is responsible for safeguarding and promoting the economic, professional, social, health and cultural interests of all staff members. The following statutory staff representations are set up in accordance with the provisions of the provincial state law of Salzburg:

1.) Staff representation of civil servants of the Province of Salzburg

The supreme body of the staff representation is the Central committee (Zentralausschuss). In addition, there are Service committees (Dienststellenausschüsse) in, inter alia, the Office of the Salzburg Provinical Government and the District Councils. The members of the Central committee and the Service committees are elected by the staff for a period of 5 years.

2.) Staff representation of civil servants of the Municipality of Salzburg

The staff representation bodies include, inter alia, the Service assemblies (Dienststellenversammlungen), the Service committees and the Standing committee (Hauptausschuß). The members of the Service committees are appointed for a period of five years.

3.) Staff representation of local government bodies and municipalities

The staff representation bodies include, inter alia, the General assembly (Bedienstetenversammlung), the Staff representation committee (Personalvertretungsausschuss) in municipalities with 20 employees or more, and the Trusted representative (Vertrauensperson) in municipalities with fewer than 20 employees. The trusted staff representative in municipalities with fewer than 20 employees, the members of the Staff representation committee in municipalities with 20 or more permanent staff where no departments are set up, and the members of the Service committees in municipalities where departments are established, are all appointed for a period of four years.

The Salzburg Civil Service Trade Union (Gewerkschaft Öffentlicher Dienst Salzburg) is an advocacy group based on voluntary membership the purpose of which is to represent the professional, economic, social, cultural and health interests of its members (all civil servants in Austria and the staff of the outsourced institutions).
 

Requirements

Employees of the Province of Salzburg are all persons in a public-law or private-law employment relationship with the Province, including persons in an apprenticeship (apprentices, trainees, etc.). The following are excluded: employees in establishments within the meaning of Article 21(2) of the Federal Constitutional Act, as amended in 1929 (e.g. Salzburg provincial hospitals), provincial teachers within the meaning of Section 42 of the Federal Staff Representation Act (Bundes-Personalvertretungsgesetzes), BGBl. No 188/1967, last amended by BGBl. No 148/1988.

No specific documents are required.

Procedure

Members of staff in the civil service fall within the remit of the statutory staff representation during their employment relationship. There are no specific procedures to be followed in this respect.

Costs and fees

For staff, there are no costs for the provision of advice from the staff representation. A membership fee is payable to the Civil Service Trade Union (2020: 1% of the gross monthly salary).

Means of redress or appeal

In accordance with Section 29 of the Provincial Staff Representation Act, the staff representation of the Province of Salzburg is subject to the supervision of the Provincial Government. The Provincial Government may, by decision, annul decisions and other measures adopted by the staff representation bodies which are contrary to the provisions of this Act and, where necessary, determine whether the management which is the subject of the proceedings is lawful or unlawful. As a last resort, the supervisory authority may dissolve a staff representation body; this is admissible only if the staff representation body repeatedly and grossly fails to fulfil its obligations. The Provincial Government, as the supervisory authority, may also be called upon by employees who fall within the remit of the staff representation body in question.
